CERTIFIED FINANCIAL GUARDIAN COURSE


Any user of the website can register for the course subject to payment of registration fees.
PersonalFN is neither a university nor an educational institution nor affiliated to one and will not grant a degree on completion of the course. The course/training material provided by PersonalFN has not been certified by any university or other educational institution or other organization qualified to provide certification. PersonalFN does not promise any job or employment or any business opportunity on completion of the course. 
A completion certificate rewarding the Users as “Certified Financial Guardian” will be issued by PersonalFN on successful completion of the Certified Financial Guardian Course.

CONDITIONS FOR SUCCESSFUL COMPLETION OF THE Certified Financial Guardian COURSE


The completion certificate will be issued by PersonalFN after the following conditions are fulfilled:

  1. The User should be an individual of the age 18 years and above
  2. The User should attend all the modules (e-lessons) of the course.
  3. The User should successfully take up the final participatory test after attending all the modules of Certified Financial Guardian

The Course Completion Certificate shall be valid for a period of 1 year from the date of issue. The Certified Financial Guardian Certification shall be renewed as per the discretion of PersonalFN. There may be renewal fees and refresher course test at the time of renewal of the Certified Financial Guardian Certification.

User Agreement

This website is a platform where:

  • Users can view information about Certified Financial Guardian on the website
  • ‘The Registered Users’ can search and interact with the Certified Financial Guardian
  • ‘The Advisors’ can list themselves as Certified Financial Guardian on the website after fulfilling the eligibility criteria and can interact with the Registered Users

PersonalFN hereby grants to the User, the right to use the website in accordance with these terms, and for no other purpose. These terms of use describes the terms and conditions on which the Users are allowed to use the Website and the Services.Any additional terms and conditions, disclaimers, privacy policies and other policies applicable to general and specific areas of services are also considered as terms of use under this User Agreement. Before using the Website, it is recommend that the User reads the whole User Agreement, and all linked information.

By accessing and/or using the Website User agrees to accept this User Agreement, and that this User Agreement will apply whenever the User uses the Website, or when the User uses the tools made available by PersonalFN to interact with the other users.

In the User Agreement:


“Account” means the account a User opens by registering on the Website. 

"Advisor”or “Adviser” means a User who can offer or provide advisory service. 

“Advisor Services”or “Advisory Services” means any investment advisory services as allowed by the Securities and Exchange Board of India (SEBI) and Association of Mutual Funds of India (AMFI). 

"Certified Financial Guardian” means an Advisor who has fulfilled eligibility criteria to get listed on the Website to provide advisory services to the Users of this Website. 

“Content” means and includes all the information about the Advisor, displayed on the website,and the information posted / submitted by the Advisor and comments and queries posted by the Users. 

“Course” means the Certified Financial Guardian course created, delivered and facilitated by PersonalFN. 

“Course Completion Certificate” means the certificate issued by PersonalFN on successfully completion of all modules of the Certified Financial Guardian course and fulfilling other criteria as required by PersonalFN from time to time. 

“Intellectual Property Rights” means any and all intellectual property rights, which is the subject matter of this Website, including patents, copyright, registered and unregistered trademarks, and any right to have confidential information kept confidential; 

“Registered User” means a user that registers on the Website to search and / or hires services of Advisors through the Website. 

“User”, “you” or “your” means an individual who visits or uses or registers with the website, including an Advisor and a Registered User. 

“Website” means and includes the websites and micro-sites operated and managed by PersonalFN and available at Certified Financial Guardian and PersonalFN and includes any related service, tool or application. 

Registration on website:



1 If you wish to receive access to the restricted content of the Website you will need to register (as a Registered User) with us and the following terms will apply. 

1.1 You agree to: 

  1. provide true, accurate, correct and complete information ("Personal Information") which you are required to provide when you register on this Website; and
  2. notify us immediately of any changes to the Personal Information.
  3. receive calls, sms or emails regarding our products or services and various promotional offers for solicitation or from associates.
  4. You agree not to: impersonate any other person or entity or to use a false name or a name that you are not authorised to use, or disclose your password or user name to any other person, or allow your password or user name to be used by any other person to access the Services.
  5. PersonalFN reserve the right to decline any application from you to register or subscribe as a user of the Services at our sole discretion.
  6. PersonalFN reserve the right to terminate your account (including user name and password) if any Personal Information is untrue, inaccurate, out-of-date or incomplete.

Users’ Obligations:


1 You: 

1.1 agree not to use the website(s) and/or the services (or any part thereof) for any illegal purpose and agree to use it in accordance with all relevant laws; 
1.2 agree not to upload or transmit through the website(s) and/or the services any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or the website; 
1.3 will not upload or transmit through the website(s) and/or the services any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety; 
1.4 will not use the website(s) and/or the services in a way that may cause the website(s) and/or the services to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the website(s) and/or the services is in any way impaired; 
1.5 will not use the website(s) and/or the services in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy); 
1.6 will not attempt any unauthorised access to any part or component of the website(s) and/or the services; 
1.7 will not violate any law or regulation 
1.8 will not contain material linked to terrorist activities
1.9 agree that in the event that you have any right, claim or action against any Users arising out of that User's use of the website(s) and/or the services, then you will pursue such right, claim or action independently of, and without recourse to us; and agree not to allow any third party directly or indirectly to use your subscription, user name or password. 

Use of Password



User shall be responsible for creating and safe keeping of his Password. In the event a User is given a password by PersonalFN, the User shall ensure that such password is kept in a secure manner. PersonalFN does not have access to such password since it is generated randomly on the PersonalFN system, encrypted and passed on to the User. In the event that the User incurs any liability to PersonalFN or any other third party as a result of the password being used by third parties, or due to improper use of the password, User shall, without limitation, bear all such liability. Notwithstanding anything contained herein, in the event any liability arising to the User as a consequence of any of PersonalFN's employees accessing the User's password without authorization shall be borne by the User. >

Listing Content and Disseminating Information



PersonalFN collects, directly or indirectly, and displays on the Website, relevant information regarding the profile and services of the Advisors listed on the Website, such as their specialisation, qualification, location, and similar details. PersonalFN takes reasonable efforts to ensure that such information is updated at frequent intervals. Although PersonalFN screens and vets the information and photos submitted by the Advisors, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts. 

The Services provided by PersonalFN are provided on an "as is" and “as available" basis, and PersonalFN disclaims any warranties,whether express or implied, including the implied warranties of merchant ability, accuracy, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade. 

The Website may contain links to the website of third parties. PersonalFN has no control over, and not liable or responsible for content, accuracy, validity, reliability, quality of such websites or made available by/through our Website. Inclusion of any link on the Website does not imply that PersonalFN endorses the linked site. User may use the links and these services at User’s own risk. 

Intellectual Property Rights (IP)



All elements contained on this Website including all articles, columns, course material and other elements making up the Service are Copyrighted works and are owned by PersonalFN and are protected by Copyright, Service Marks and Trademark laws, International Treaty provisions and/or other proprietary rights under the laws of India and this Terms of Use. By using the service you agree to abide by all applicable Copyright and other laws as well as any additional Copyright notices or restrictions contained in the Service. PersonalFN or other third parties shall be entitled to obtain equitable relief for any violation of their IP, over and above all other remedies available to it to protect its interests therein. Violators will be liable to be prosecuted to the maximum extent possible. Copying for reproduction, for redistribution or other purpose of the web site or any part thereof including but not limited to text content and graphics to any other server or location including caching of any kind is expressly prohibited. The Service is licensed to the User not sold to him. PersonalFN owns the Service, its applications and Trademarks. 

Privacy



The User represents that he is aware that in the process of using the services or parts of it, PersonalFN may obtain information relating to the User, including that of a confidential nature. This information will be used by PersonalFN for its internal purposes and will be kept confidential. Notwithstanding anything contained above, PersonalFN reserves the right to disclose personal information where it believes in good faith that such disclosure is required by law, to perform necessary credit checks or collect or report debts owed to PersonalFN, to protect PersonalFN's rights or property or for other bonafide users. The User agrees and warrants that all information that PersonalFN may possess or may obtain pursuant to the use of Service has been possessed or obtained with the permission of the User. Content and Comments



The views, opinions and comments posted are of the User, and are not endorsed by this website. The User shall be solely responsible for the comments posted on the website. When Users post feedback and / or comments, Users grant PersonalFN a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, right to exercise any and all copyright, trademark, and database rights in the content, in any media known now or in the future. 

Any and all content submitted to the Website is subject to approval of PersonalFN. PersonalFN may reject, approve and modify User content, at its sole discretion. 

Users acknowledge that copyright of the feedback and reviews consisting of comments and a rating,including composite rating belong to PersonalFN. 

In addition to the general restrictions above, the following specific restrictions and conditions apply to User’s use of content on the PersonalFN Website. 

Content on the Website is provided to you AS IS for your information and personal use only and shall not be copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the PersonalFN. PersonalFN reserves all rights not expressly granted in and to the Website and the Content. 

User agrees to not engage in the use, copying, or distribution of any of the Content of the Website for any commercial purposes. 

User agrees not to circumvent, disable or otherwise interfere with security-related features of the PersonalFN Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the PersonalFN Website or the Content therein. 

Rating System



PersonalFN’s rating algorithm for the Advisors is a fully automated system that lists the Advisors, their profile and information regarding their services on its Website. These listings of Advisors do not represent any fixed objective ranking or endorsement by PersonalFN. PersonalFN will not be liable for any change in the ranking of the Advisors, which may take place from time to time. The listing of Advisors will be based on automated computation of the various factors including inputs made by the Users including their comments and feedback. The ranking algorithm is proprietary technology and cannot be disclosed in full. Such factors may change from time to time, in order to improve the listing algorithm. PersonalFN in no event will be held responsible for the accuracy and the relevancy of the listing order of the Advisors on the Website. 

Communication with other Users



Users must not post their email address or other contact information on the Website, except in the field mentioned in the signup form, or as otherwise permitted by PersonalFN on the Website. 

Users shall only communicate with other Users via the Website, including by using the comment section or chat facilities, as provided on the website. 

Rights of PersonalFN



PersonalFN may, at its absolute discretion, refuse to register a person as an Advisor or Certified Financial Guardian and may deactivate or suspend the account of a Certified Financial Guardian, including for breach of terms of this User Agreement. Once suspended, or terminated, the Certified Financial Guardian cannot continue to use the Website under the same account, a different account or re-register under a new account. 

An Independent Board shall be constituted by PersonalFN to hear any complaint or issue from any User or to decide the registration of any User. The Board may proceed with the complaint of any User, if any, if the Board deems complaint to be accurate. 

The decision of PersonalFN / Certified Financial Guardian Board in all cases shall be final and binding on all users of Certified Financial Guardian website. 

Disclaimer For Harm Caused To Users’ Computer From Interacting With This Website



The website assumes no responsibility for damage to computers or software of the visitor or any person the visitor subsequently communicates with from corrupting code or data that is inadvertently passed to the visitor's computer. Again, visitor views and interacts with this site, or banners or pop-ups or advertising displayed thereon, at his own risk. 

Right To Review


PersonalFN may read all correspondence posted to the Website and download or access, and test (if necessary), all uploaded files, programs and websites for the purpose of investigating fraud and for risk management and related purposes. 

Limitation Of Liability


In no event shall PersonalFN, its directors, its employees, its associates and affiliates, whether in contract, warranty, tort (including negligence), or any other form of liability, for:

  • any indirect, special, incidental or consequential damages that may be incurred by User;
  • any loss of income, business or profits (whether direct or indirect) that may be incurred by User;
  • any claim, damage, or loss which may be incurred by User as a result of any of User’s transactions involving the Website.

PersonalFN shall also not be liable for errors, omissions or typographical errors, disruption delay, interruption, failure, deletion or defect of/in the Service provided by it whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.


Governing Law and Jurisdiction


This Terms of Use is governed by the laws of the Republic of India. The User hereby consents and submits to the exclusive jurisdiction and venue of Courts in Mumbai, India in all disputes arising out of or relating to the use of this Web site or Service.


General


Nothing contained in this Terms of Use is in derogation of PersonalFN's right to comply with Governmental, Court and Law enforcement requests or requirements relating to use of this Web site, Service or information provided to or gathered by PersonalFN with respect to such use. 

This User Agreement constitutes the entire agreement between the User and PersonalFN with respect to this Web site and the Services provided by PersonalFN. PersonalFN reserve the right to revise the terms of use at any time by posting an updated terms of use with or without advance notice to the user. 

Foreign Jurisdictions


All Users of the Service in countries other than India understand that by using the Service, they may be violating the local laws in such countries. If the User chooses to access the Service from outside India, he shall be responsible for compliance with foreign and local laws. The Users agree that they will solely be liable for any liability incurred by them in this regard and will indemnify PersonalFN for any liability PersonalFN may incur in any foreign jurisdiction as a consequence of citizens / residents of countries other than India using the Service. This service does not constitute an offer to sell or a solicitation to any person in any jurisdiction where it is unlawful to make such an offer or solicitation. 

Feedback


PersonalFN reserves the right to reproduce clients’ views, in part or full, about its services in its product promotions or in its communications with prospective clients. Clients who do not wish their views to be used as above may intimate PersonalFN in writing to this effect.

Termination


If the User violates any term of this Terms of Use, PersonalFN or Certified Financial Guardian Board may terminate the User's access to this Web -Site, without waiving any other rights. The User would continue to remain liable for any liabilities that may have arisen before the termination.


Closing A User Account



Users may close their Account at any time by emailing us at cfg@personalfn.com , subject to:

  • not having any outstanding obligations on the Website; and
  • resolving any outstanding matters and
  • paying any outstanding fees owing on the Account.

Specific Terms for Certified Financial Guardian:


Advisors should fulfill all the following criteria to get listed on the website as Certified Financial Guardian:

  • An advisor should be an Indian citizen.
  • An advisor should successfully complete the Certified Financial Guardian Course and should have valid course completion certificate.
  • Advisor should not be have been barred from rendering services under the laws of India or other applicable jurisdiction;
  • An Advisor should have a valid email id and mobile no.
  • An Advisor should have any one of the following valid certifications:
    • SEBI registration under SEBI (Investment Advisors) Regulation, 2013;
    • AMFI Registration No. (ARN)
    • An employee of entity registered under SEBI (Investment Advisers) Regulation, 2013

Documents required:

  • Advisors are required to submit self attested scanned copies of the certifications as mentioned in above point no. 5 (as applicable).
  • If the Advisor is an employee of an entity, Advisor should submit:
    • Scanned copy of the certificate issued by SEBI under SEBI (Investment Advisors) Regulation, 2013
    • Scanned copy of letter from the entity authorizing the Advisor to interact on behalf of the entity. It is the responsibility of the entity to ensure that the representative fulfills the qualifications as required under SEBI (Investment Advisers) Regulations, 2013.

Additional Terms and Obligations for Advisors:

  • The advisors will be listed on Certified Financial Guardian website only when the documents are verified and approved by PersonalFN.
  • If the Certified Financial Guardian certification is due for renewal, the Advisor shall be allowed to be listed on the Certified Financial Guardian website only on the successful renewal of the same.
  • If the Certified Financial Guardian certification is not renewed, the account of the advisor on Certified Financial Guardian website shall be deactivated.
  • If PersonalFN determines that the advisor on Certified Financial Guardian website has made misrepresentations including furnishing inaccurate or fraudulent information, PersonalFN reserves the right to immediately suspend the account with PersonalFN and shall make such declaration on the website alongside the name of the advisor as determined by PersonalFN for the protection of its business and in the interests of Users. Certified Financial Guardian shall be liable to indemnify PersonalFN for any losses incurred as a result of misrepresentations that has adversely affected PersonalFN or its Users
  • PersonalFN, directly and indirectly, collects information regarding the Certified Financial Guardian profiles, contact details, and service, and publishes these details on the Website. On Certified Financial Guardian request, PersonalFN may allow display of any part of such Advisor’s profile on the Website. However, PersonalFN shall, at no time, be under any obligation to display publicly available information about a Certified Financial Guardian, his/her profile, contact details and/or services. All information regarding the Certified Financial Guardian profiles, contact details, and services is collected for the purpose of facilitating interaction among Users.
  • If any information displayed on the Website in connection with Certified Financial Guardian is found to be incorrect, Advisor is required to inform PersonalFN immediately to enable PersonalFN to make the necessary amendments.
  • Certified Financial Guardian is allowed to interact with Registered Users only after the Registered Users first contact Certified Financial Guardian.
  • Certified Financial Guardian cannot transfer (including by way of sublicense, lease, assignment or other transfer, including by operation of law) their login to any third party.
  • PersonalFN is not responsible for verification of “Know Your Client” (KYC) requirements for Registered User as prescribed by the regulatory authorities.
  • Certified Financial Guardian are free to accept or reject or decide the terms of service to the Registered Users.
  • Certified Financial Guardian shall be responsible to comply with applicable laws, rules and regulation, from time to time, in order to service the Registered User.
  • Certified Financial Guardian may be required to give a declaration as per the format required by PersonalFN from time to time.
  • Unless otherwise agreed by PersonalFN, Certified Financial Guardian shall not advertise any external website, product or service on the Website. Any website address posted on the Website must relate to a service being offered to the Registered User by Certified Financial Guardian.
  • PersonalFN may, at its absolute discretion, refuse to register a person as an Advisor and may deactivate or suspend the account of an Advisor, including for breach of terms of this User Agreement. Once suspended, or terminated, the Advisor cannot continue to use the Website under the same account, a different account or re-register under a new account.

Specific Terms for Registered Users:


  • Users should register themselves on the Certified Financial Guardian website in order to interact with the Certified Financial Guardian.
  • Registered Users shall themselves search for the services of the Certified Financial Guardian as per their own requirements.
  • PersonalFN does not endorse services of any particular Certified Financial Guardian and shall not be liable or responsible for breach of services or service deficiency by the Certified Financial Guardian.
  • Certified Financial Guardian are free to accept or reject or decide the terms of service, including fees charged, to the Registered Users. PersonalFN shall not be responsible for the terms of the agreement between Certified Financial Guardian and the Registered User.
  • Registered Users can rate the Advisors only after they have met the Certified Financial Guardian and / or have availed services of the Certified Financial Guardian.
  • PersonalFN shall not be responsible for cancellation or rescheduling of booked appointment or any variance in the services by Certified Financial Guardian.
  • Registered Users, who avail services of Certified Financial Guardian, shall directly pay fees to the Certified Financial Guardian.
  • Once the Registered Users avail Advisory Services, it will be the sole responsibility of the Certified Financial Guardian to fulfill its commitment and obligations.
  • Registered Users cannot transfer (including by way of sublicense, lease, assignment or other transfer, including by operation of law) their login or right to use the Services to any third party.
  • Information on the Websites may contain general information about personal finance related topics and other matters. Registered User must not rely on the information on the Website as an alternative to professional advice. If Registered Users have specific questions about any matter they should consult their Advisor.
  • The Registered User who have availed other services of PersonalFN or subscribed to other products of PersonalFN are bound by the terms of use of those service and / or product.
  • Registered Users agree to avail services of the Certified Financial Guardian at their own risk. PersonalFN shall not be responsible for any loss or liability incurred by the Registered User on hiring services of the Certified Financial Guardian.
